These Terms of Use (End User License Agreement, "EULA") govern your use of the SpinGoal mobile application and website ("the Service", "we", "us", "our"). By accessing or using SpinGoal you agree to be bound by this EULA. If you do not agree, discontinue use immediately. This EULA forms a legally binding agreement between you ("User") and SpinGoal, operated by Nawify. See also our Privacy Policy.
1. Acceptance of Terms
By upgrading to Pro, restoring Pro access, or using any feature on the site, you acknowledge that you have read, understood, and agree to these Terms. You also agree to our Privacy Policy and Cookie Policy.
2. Description of Service
SpinGoal is a free browser-based spinning wheel randomizer designed for entertainment, education, and organizational purposes — including random draws, classroom activities, live-stream giveaways, and gaming tournaments. The Service includes a free tier and optional premium ("Pro") features.
3. Eligibility
You must be at least 13 years old to use the Service. Users under 16 in the EU (the applicable age of digital consent under GDPR) require verifiable parental or guardian consent. By using the Service you confirm you meet these requirements.
4. Permitted Use
You may use the Service solely for lawful, non-commercial purposes. Permitted uses include:
- Random selection for games, competitions, and giveaways.
- Educational classroom tools and activities.
- Live-stream entertainment on platforms such as Twitch, YouTube, and Kick.
- Personal decision-making and entertainment.
5. Prohibited Use
You agree NOT to use the Service for:
- Any form of illegal gambling, wagering, or betting under applicable law.
- Fraudulent or deceptive giveaways where results are predetermined.
- Collecting, scraping, or harvesting personal data of other users.
- Transmitting malware, spam, or any harmful code.
- Reverse engineering, decompiling, or extracting source code.
- Systematic or automated access (bots, scrapers) without written consent.
- Any activity violating applicable national, EU, or international law.
6. Intellectual Property
All content, design, code, graphics, and branding of SpinGoal are the exclusive intellectual property of Nawify, protected under EU and international copyright, trademark, and IP laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.
7. User-Generated Content
Entries you type are processed locally and not transmitted to our servers unless you use Multiplayer. You retain full ownership of your content. Multiplayer use grants SpinGoal a limited license to temporarily store and transmit your entries to synchronize sessions, as described in our Privacy Policy.
8. Pro Features, Subscriptions & Payments
Certain features require a Pro subscription or one-time payment.
8.1 Auto-Renewable Subscription — SpinGoal Pro Monthly
- Title: SpinGoal Pro Monthly
- Length: 1 month (auto-renewing until cancelled)
- Price: Displayed in the app at time of purchase via the App Store (localized by Apple)
- Billing: Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
- Cancellation: You can manage or cancel your subscription anytime in Settings → Apple ID → Subscriptions on your device.
- Free trial: If offered, any unused portion of a free trial is forfeited when you purchase a subscription.
8.2 Lifetime Access (Non-Consumable)
SpinGoal Pro Lifetime is a one-time purchase that does not auto-renew. It unlocks Pro features permanently for the Apple ID used at purchase, subject to these Terms.
8.3 General Payment Terms
All purchases are final unless required otherwise by applicable consumer protection law, including the 14-day cooling-off right under EU Directive 2011/83/EU for digital services where applicable. Promo codes are single-use and have no monetary value. We reserve the right to modify, suspend, or discontinue Pro features with 30 days' notice. Apple is not a party to this EULA and is not responsible for the Service or its content.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAWIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. WHERE SUCH LIMITATIONS ARE NOT PERMITTED (E.G. CERTAIN EU MEMBER STATES), LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Netherlands (EU). Disputes shall first be submitted to good-faith mediation. If unresolved within 30 days, disputes are subject to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands — without prejudice to your rights as an EU consumer to bring proceedings in your country of residence.
12. EU Consumer Rights
Nothing in these Terms affects your statutory rights under applicable EU Directives, including the Consumer Rights Directive (2011/83/EU) and the Digital Content Directive (2019/770/EU). You have the right to withdraw from a digital service contract within 14 days, unless performance has begun with your prior express consent.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated at least 30 days before taking effect. Continued use after changes become effective constitutes acceptance of the revised Terms.
14. Termination
We reserve the right to suspend or terminate your access at any time if we reasonably believe you have violated these Terms. All licenses granted under these Terms immediately cease upon termination.
